Informed Consent For Psychotherapy & Therapist Disclosure

Behavioral and mental health therapists, such as psychiatrists, psychologists, counselors, licensed clinical social workers, and licensed marriage and family therapists, are required to provide written disclosure of the following information to clients before therapy begins, and to obtain signed consent to counseling and therapy.  Please read this statement thoroughly and, when you understand and agree to it, approve the consent for therapy.  This signed statement, along with your Teletherapy Informed Consent, is your written contract to enter into a therapy relationship with your therapist.  As a client, you have a right to refuse therapy and the right to choose a therapist and treatment modality that best suits your needs and objectives.

OVERVIEW

Marvin Behavioral Health, Inc. (“Marvin”) is a technology platform (“Platform”) that facilitates your access to behavioral health services provided by psychiatrists, psychologists, independent clinical social workers, professional counselors, and other types of licensed therapists who are under contract with professional corporations affiliated with Marvin (“Professional Corporations”).  Teletherapy sessions are provided through encrypted interactive live video using HIPAA-compliant technology (also known as synchronous teletherapy).  Your therapist will maintain notes and records of your therapy on the Marvin Platform.  All technology associated with the Marvin Platform will be wiped clean of any client information before disposal.

 

You will be assigned a therapist.  Your therapist will be licensed in the state where you are located.  You will be asked what your primary language is and, if possible, you will be assigned to a therapist who speaks that language.  You may schedule therapy sessions through the Marvin Platform.  While the services should not be used in an emergency, if you would like to speak with a therapist, and your assigned therapist is not available, Marvin will assign you to a different therapist who is available.  Additional information required by the state where you live can be found in the Addendum to this Disclosure Document.

THERAPIST CREDENTIALS

Your therapist’s credentials, such as education, licensure, and experience will be available on the Marvin Platform.  

NATURE OF THERAPY

You may choose to participate in various therapy delivery models as follows:

 

  • Individual Therapy Sessions.  Individual therapy sessions are 60 minutes in length and occur on a weekly basis or other intervals that you and your therapist select.  Your therapist will perform an initial assessment and develop a therapeutic treatment plan for clients.  Your therapist will conduct ongoing assessments of your progress and adjust treatment plans as appropriate.  

  • Group Therapy Sessions.  You may participate in group and mentorship programming with other clients to supplement their therapy experiences.  This may include group therapy programs oriented around specific topics, 1:1 peer meditation exercises, or other formats that engage clients with one another.  

  • Therapy Exercises.  You may access online meditations and other self-service exercises within the Marvin Platform.  Exercises and other content are based upon standard therapeutic modalities.  

 

The purpose of therapy is to help you with mental health  challenges and emotional difficulties so that you can function better and increase your well-being.  You and your therapist will discuss your specific goals of the therapeutic relationship.  Based on these goals, your therapist will determine the nature of therapy and the anticipated course of therapy, as well as inform you of factors that may impact the duration of therapy services.  If the therapy does not meet your needs, then your therapist will inform you of possible alternative therapies, including in person therapy.  

 

Therapists will not record therapy sessions.  

 

You are expected to attend your therapy sessions as scheduled with your therapist, working with your therapist to address your concerns and goals for therapy. In addition, you may be asked to do homework between sessions. These homework assignments can help you apply what you've learned in the therapy sessions to your life.

INVENTORIES

Marvin and your therapist utilize clinical inventories during the course of providing services to you, including:

  • PHQ-9, GAD-7, and the Maslach Burnout Inventory at intake,

  • PHQ-9, GAD-7, and the Outcome Rating Scale prior to each session, and

  • The Session Rating Scale after each session.

NEW THERAPY TREATMENTS

If your therapist proposes treatment for which generally recognized techniques and procedures have not been established, your therapist will inform you of the developing nature of treatment, the potential risks involved, alternative treatments that may be available, and the voluntary nature of your participation.

THERAPY TRAINEES

In some cases, therapists may be students or trainees who are supervised by a licensed supervisor.  You will be informed if your therapist is a student or trainee and provided the name, telephone number, and license number of the therapist’s supervisor.  Supervisors are responsible for the therapy services provided, and they will have full access to your treatment records in order to perform their supervision responsibilities.  Fees for your therapy services are paid to the supervisor. 

INFORMED CONSENT

Before the commencement of therapy, you will be asked to sign or approve a Teletherapy Informed Consent document as it relates to the use of teletherapy as the mode of delivering therapy.

FEE INFORMATION

If you are interested in receiving therapy services, you will need to go to the Marvin Platform at www.meetmarvin.com and submit a message requesting information about the therapy fees, sent to billing@meetmarvin.com.  The fees are based on factors such as type of therapist, experience of therapist, location of the therapist, whether Marvin has a contract with your employer, and whether you have insurance. Marvin will respond to your message with the fee amounts for therapy based on the information that you provide and, if you have insurance, the amount of your financial responsibility such as co-pays, deductibles, and other co-insurance (“Responsibility Amounts”).  If your therapist or the Professional Corporation is in network with your insurance company, then Marvin will submit claims for payment to your insurance company.  If your therapist or Professional Corporation is not in network with your insurance company, then Marvin will fill out a claim form that you can submit to your insurance company.  

 

It is your responsibility to determine whether your sessions are covered by your insurance or your employer.  It is also your responsibility to verify all insurance coverage information that Marvin provides to you.  A quotation of benefits provided by Marvin is not a guarantee of payment by your insurance company.  You are responsible for any fees your insurance company or employer do not cover.  In addition, you will be responsible for paying any Responsibility Amounts, as required by your insurance plan, directly to Marvin.

 

If you wish to proceed with therapy services after receiving the fee information, you may proceed with registering an account with Marvin.

 

Fees and known Responsibility Amounts for which you are responsible (rather than insurance or your employer) must be paid through the Marvin Platform before therapy services are provided.

 

If services have not been paid by your insurance or employer within 30 days after they were performed, Marvin will ask you to make payment or contact your insurance carrier to make payment in a timely manner.  If your account has not been paid for more than 90 days, Marvin may terminate or suspend therapy services and/or use legal means to obtain payment, including hiring a collection agency.  If such collection action is necessary, Marvin’s costs will be included in the claim.  When collecting payment, the only information that will be released is your name, the nature of services provided, and the amount due.

 

This consent gives Marvin permission to charge your credit card for any services unless you cancel this authorization in writing.  Your consent constitutes preauthorization to collect payment for services in this manner cancel this authorization in writing.  Your consent constitutes preauthorization to collect payment for services in this manner.

 

You are not responsible for any fees or charges for services rendered prior to receipt of this Disclosure Document.

MISSED APPOINTMENT POLICY

If you need to reschedule or cancel an appointment, we are happy to assist.  You must notify Marvin at least 24 hours before your appointment of your need to reschedule or cancel your appointment.  If you cancel with fewer than 24 hours’ notice or miss your appointment, you will be charged a $40 fee for your missed appointment.  This policy helps us ensure that all of our clients receive timely care, as we generally are not able to fill slots canceled within 24 hours of the appointment.  

CONFIDENTIALITY

Your privacy is important.  Marvin, the Professional Corporations, and your therapist are committed to maintaining the confidentiality of your registration and intake information and therapy sessions to the same extent as if you had an in-person therapy session.  Your therapist will not disclose any information that you share during your counseling relationship without a signed release, except in the following cases:

 

  1. You consent in writing for your therapist to disclose the information.

  2. If you die or become disabled, your personal representative or the beneficiary of an insurance policy on your life, health, or physical condition, consents in writing for your therapist to disclose the information.

  3. Your therapist believes that you could be contemplating or committing a crime or harmful act.

  4. You waive the privilege by bringing charges against your therapist.

  5. Your therapist receives a subpoena from a court of law or governmental agency that requires your therapist to disclose the information, or your therapist’s licensing board requires your information as part of a board investigation of a complaint or as part of a disciplinary or other proceeding against your therapist.  

  6. Your therapist has reasonable cause to believe that a child has suffered abuse or neglect or that abandonment, abuse, financial exploitation, or neglect of a vulnerable adult has occurred.

  7. Your therapist may disclose your health information to Marvin and the Professional Corporations in connection with their provision of administrative services to your therapist and in order to bill and collect payment for the services that you receive.  For example, they may contact your health insurer to certify that you are eligible for benefits (and for what range of benefits) and may provide your insurer with details regarding your therapy to determine if your insurer will cover, or pay for, your treatment.  If you do not wish for these disclosures to be made to your insurance company, you may pay for the services yourself.  

  8. Your therapist may discuss your treatment program with other professionals, but your name will not be shared and confidentiality will be maintained.

 

Participants in group therapy sessions are asked to keep information shared during these sessions confidential.  

 

In the case of an emergency, your therapist may contact your designated contact to help coordinate obtaining emergency care for you.    

 

Your therapist will maintain your records for at least 5 years after provision of therapy services.

​BENEFITS AND RISKS OF THERAPY

While the benefits of therapy cannot be guaranteed, possible benefits include reduced feelings of emotional distress, improvement in personal relationships, increased ability to problem solve, and a positive change in perspective.  As with any treatment, though, there can be risks.  For example, during therapy sessions, you and your therapist may discuss personal issues that bring up emotions such as anger, guilt, sadness, worry, trauma or stress.  One of the goals of your treatment is to work through these emotions.  Alternatives to therapy include peer support, medication management, physical exercise, self-help or self-improvement literature, or meditation-based content.  You may revoke your consent to therapy at any time by deactivating your Marvin account.

CLIENT RIGHTS

As a client, you have certain rights, including:

 

  • The right to respect from your therapist

  • The right to choose (and change) your therapist, treatment modality, and therapy goals 

  • The right to refuse or terminate treatment and to request a different therapist

  • The right to file a grievance about your therapist with your therapist’s licensing board as noted on Addendum B to this Disclosure Document.

UNPROFESSIONAL CONDUCT

If you are dissatisfied with the services you’ve received from your therapist, you believe that your therapist is engaging in unprofessional conduct, or that your therapist is not maintaining professional boundaries, please email user-success@meetmarvin.com and one of our staff will follow-up with you.  You may also contact your therapist’s licensing board at the contact information described on Appendix B.

TRANSFER OF RECORDS

If your therapist dies, becomes disabled, ceases providing services in your state, no longer provides services through the Platform, or you request a different therapist, you will be assigned a different therapist to continue providing services to you.  In this case, your contact information and records will be provided to your new therapist for purposes of providing future services to you.  However, you may notify Marvin that you do not wish for your contact information and records to be transferred to a new therapist.  The new therapist will maintain the records in accordance with any applicable state or federal laws or rules.   

TERMINATING THERAPY SERVICES

Your therapist may terminate your therapy relationship if your therapist believes that you are not a good fit for a teletherapy-based model.  For example, you have acute symptoms, you need in-person services, or for other good reasons.  Your therapist will provide you with prior notice to give you time to find another therapist.   

CONTACTING YOUR THERAPIST

You may send your therapist a message outside of your scheduled sessions by email or through the Marvin Platform.  Your therapist will respond to messages within 72 hours.  Your communications with your therapist will be stored on the Marvin Platform.  

INFORMED CONSENT AND AUTHORIZATION FOR SERVICES

By accepting this form, I confirm that I have been provided a copy of this Disclosure Document, that I have had the opportunity to ask questions, and that I have read, understand and agree to the information provided.  I agree to receive counseling or therapy services from my therapist and understand that I may stop such treatment or services at any time.  I understand that this consent shall continue for as long as I receive services from a Marvin therapist.
